AMERICA'S FORGOTTEN HISTORY
December 23, 2003
We are often overwhelmed by the moral bankruptcy and the economic decline of our once godly and prosperous nation. Legalized sodomy, pornography, abortion, massive taxation, a fiat money system, a decreasingly devalued dollar, millions of unemployed, a bankrupt welfare system that keeps people in poverty for generations, record personal bankruptcies, outsourcing of jobs to foreign countries, massive unchecked immigration and terrorism. We have become by far the largest debtor nation in the world with a 45 trillion-dollar debt that is growing by 1.5 trillion dollars each year. Certainly trillions more debt will be added with the recent passage of a Medicare prescription bill for seniors by our current immoral "conservative" administration. This program by our supposed "small government" Republican representatives dwarfs Democrat Franklin Roosevelt's "New Deal" and Democrat Lyndon Johnson's "Great Society". We are worried about our future and the future of those who will come after us in this socialist nightmare, as well we should be. When baby boomers start retiring in about 5 years who is going to pay the bills? We have aborted tens of millions of those who would be paying into this system. Our moral bankruptcy has our nation on the verge of collapse. What happened to bring the most free and prosperous nation on earth to her knees?
America has forgotten her history. She is being destroyed by tyrannical legislators that pass laws that benefit only themselves and increase their own wealth and power over us. I'm reminded of the book of Deuteronomy where Moses continually encourages the Israelites to remember the covenant with the God of their patriarchs who freed them from Egyptian bondage. We also need to be called upon to continually remember the God of our fathers. It was belief in that Higher Power of the universe that once gave us the best legal system man has ever known. Every individual had an inalienable right to life, liberty and property. Not only could one's neighbor not encroach on you or your property without penalty, but the individual was also protected from government encroachment. The loss of that legal system that valued every individual, based on a power higher than any human power, is the direct cause of America's current moral and economic tragedy.
America became the most free and prosperous nation on earth because she once followed the principles of the old British Common Law, which were rooted in religious principles. In the early years of our nation, this law was largely used by everyone, including government officials. The common law came into being as a result of what is called "Natural Law" which was the belief of our founding fathers. The common law is in essence what our founders were fighting for in the American Revolution. In our Declaration of Independence our founders mention "The Laws of Nature and of Nature's God". Natural Law meant that the principles of law were built into the fabric of the universe. A person is endowed by his Creator with a right to life, liberty and property. Natural Law included as a sub-set, moral principles. Lawyers and judges were once held in high esteem because they were regarded on a level with scientists, as it was their job to discover and apply the laws of the universe. Just as in any physical science, there was cause and effect in following the moral laws of the universe. Right and wrong behavior was scientifically tested generation after generation to see what worked to create a content and productive people and therefore peace and prosperity to the community at large. Life was better when the laws were followed. When fraud or force was used civilization took a great leap backwards. These scientifically tested laws then became known as the common law.
When people hear that the common law was based on religious principles,
they worry that someone is going to force their religious beliefs
on them, but that is not the case. The common law was based on the
two fundamental principles on which all major religions and philosophies
agree. Economist Richard J. Maybury summed up these two fundamental
laws in his book, "Whatever Happened to Justice".
Since the Nuremberg Trials after World War II, which still held onto the common law principle of a Higher Power, no one is searching for that Higher Power any more or learning about it in school. In fact, God has been outlawed from school. We are told it is for our own good and in the name of fairness that He has been outlawed, but who really benefits when religion is tossed out? Since tossing out religion meant tossing out our nation's legal system, the answer is that only would-be tyrants benefit. Without God there are no limits to their power. In essence the state becomes the new god and the people are obligated to obey every whim of these tyrannical dictators.
Are you old enough to remember when America had "peace" officers instead of "police" officers? A police officer enforces the laws of the state even if the laws are immoral. That is why people are afraid of a "police state". A peace officer keeps the peace by protecting us from encroachment and fraud, the two fundamental laws. The police officer is a political tool of the politicians. Free countries have peace officers while unfree countries have police officers.
Police officers today enforce what Richard Maybury calls in his book, "political law". It is based on nothing but the whims of those in power over us. Dictator of China, Mao Tse-Tung was right when he said "Political power grows out of the barrel of a gun". Political power is using force on peaceful citizens. Legislators can pass any silly laws they want and back them up with a gun. History has shown us that power is as addicting as any drug. To be able to force others to do your will with nothing to stand in your way is a pretty heady thing. Our founders understood the sinful nature of man very well and knew no human could be trusted with power. That is why George Washington said, "Government is not reason, it is not eloquence, it is force; like fire, a troublesome servant and a fearful master." We have let the fire get out of control and the government that was supposed to be our public servant has indeed become our master. Most legislation robs Peter to pay Paul and of course no one wants to be Peter. We no longer have any concept of justice. Instead of the individual responsibility that God commands, everyone wants to use the privilege of government force to live at the expense of someone else. And when it comes down to it, what laws do Americans even have to protect themselves from a murderous rampage by the likes of tyrants like Stalin, Hitler or Mao Tse Tung? The answer is - none. There is no longer protection for the most vulnerable in our society. We have murdered tens of millions of pre-born babies and what about the handicapped? We nearly murdered Mrs. Terri Schiavo in Florida. The value of life is now up to mere human whim. The truth is there is nothing any longer standing in the way between us and a human holocaust in America. In not protecting the most vulnerable, we are all at risk. We no longer have the common law based on religious principles to protect the individual. We have democracy, majority rule, which benefits only the powerful.
America was not founded as a democracy, majority rule - in fact our founders detested democracy. Yet we are continually brainwashed since day one in government schools that America is a democracy. Why would that be? There is no freedom with democracy and I submit that that is why we were trained to believe that we are one. Unfortunately, because of that training, we are degenerating into a democracy. We also are continually subjected to hearing how we must fight for democracy around the world, but only a rational legal system can bring real liberty. You can't bring liberty to a people who have no foundation on which to base that liberty. Remember the French Revolution? They fought for democracy and all they got was the Reign of Terror and the guillotine. The American Revolution was about a Higher Law and liberty. Anyone who truly wants to understand what is going on in the world today needs to study the differences between the American and French Revolutions.
Without a scientific legal system, there is no country that can long survive. Henry Sumner Maine in his 1861 book, "Ancient Law" said that in civilizations that have now disappeared, historians find "the severance of law from morality, and of religion from law, belonging very distinctly to the later stages" of the dead civilizations' legal thinking.
I fear America will soon be among those disappearing civilizations if she does not return to her original foundations of law. That can only happen if we educate ourselves and in turn help to educate others. Books by Richard J. Maybury are great primers.
We need to get the word out. Many think it is too late to do anything to fix our out-of-control bureaucratic government. Once it has gotten so enormous they say it is impossible to get it to shrink and that America is destined to collapse of its own weight just like the Roman Empire did. That may be true, but whether it is true or not, education in economics and the common law are essential for our survival. We need to do our best to educate ourselves and all those within our influence. We need to vote properly and to hold our representatives accountable. If we continue the current immoral trend and the American socialist system collapses, just maybe with the knowledge of our forgotten history God will grant us a new beginning in liberty. After all, just like the Israelites of old, the history we forgot is the God of our fathers who is the only true arbiter of liberty.
